1. Accepting the Terms:
Attempting to join HighBorns [hereafter referred to as "The Corp" or "Corp"] or engage in any form of interactoin, including but not limited to PvP, PvE, missioning, ratting, mining, chatting, EVEmailing, can flipping, wreck salvaging, probing, or entering any starsystem or chat channel by any means including but not limited to stargate jump, jump clone, medical clone, cyno jump, logging on, character creation, or GM interaction during, before, or after the occupation of one or more members of (past, present, or future) the corp sigifies that you have read, understood, and accepted this agreement in full [hereafter referred to as "The Agreement"].
2. No Warranties:
The Corp, chat, and all interactions, and all other services and material provided in connection therewith, are provided "AS IS," with all faults, and without warranty of any kind. You assume all risk of use and all risk associated with accessing the Corp and any and all internaction thereto.
HighBorns disclaims all warranties, whether express or implied, including without limitation the warranties of merchantability, fitness for particular purpose and non-infringement.
The Corp and its members may become unavailable for a number of reasons, including without limitation during the performance of maintenance to the Game System, for the implementation of new software, for emergency situations, account disablement, "real life", and due to equipment or telecommunications failures.
3. Disclaimer of Damages;
In no event shall The Corp, its affiliates or associates, or its members be held accountable or liable to you or any third party for any special, indirect, incidental, consequential, punitive or exemplary damages (including without limitation, lost profits or lost ships or lost equipment or lost clones/implants), arising out of or in connection with your association, interaction, or any services or materials provided in connection therewith, whether based on warranty, contract, tort or any other legal theory, and whether or not The Corp is advised of the possibility of such damages, and even if any stated remedy fails of its essential purpose.
4. Indemnity:
You shall defend, indemnify and hold harmless The Corp and its affiliates, associates, members, officers, and directors, from any and all claims, loss, damages and demands, including any and all fees, legal or other, arising out of: (i) your use or misuse of The Corp; (ii) your access to The Corp; (iii) any activities conducted through your Account (whether by you or another person).
5. Miscellaneous:
If any part of the The Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law or rule to reflect, as nearly as possible, the original intentions of the parties expressed in The Agreement, and the remaining portions shall remain in full force and effect.
The Agreement in no way, expressed or implied, encourages or validates activities or actions contrary to either or both the EULA or Rules Of Conduct set forth by CCP.
